But there is a preferential creditors list and an order of priority in who gets paid first. The only way around that was if the football creditor was classified as a secured creditor, who held a charge over a business asset (most likely the player the club bought). For me, they shouldn't be and should be classed as a trade creditor.

Not in Bolton’s case now

Sounds like straw clutching to me, but who knows.

EFL should have stepped in ages ago, if you can pay wages and fulfil fixtures then you default as an owner in my opinion. Bury brought league two and spent well over what they should have, Bolton have been sadly rotten to the core for years.
We may have wankers for owners but they have kept us afloat safely

Sounds like bollocks, and personally if someone's coming in right now with proof of funds it's because they don't want to be properly scrutinised prior to sale. Be wary. Be very, very wary.

tbf if you were a Bury fan, you'd now take a bid from a consortium involving Pol Pot, Pinochet, Stalin, Mussolini and Farage.

They’d still probably be a bit wary if it was SCC - Swinson, Clegg and Cable

Yeah, the timing does seem suspect. Unless a lifelong fan with money to burn who decided at the last minute to step in. But yeah, doubtful.

They’ve got to draw a line somewhere though. Apparently the EFL are issuing a statement before 7pm tonight.

I imagine there are a few nervous Bury fans at the moment.

Even if they extend at this stage it could be too late for this season with the fixtures piling up. It might be that they give them a week, if the takeover goes through they start in League Two next year. If not they go bust.

Yep. I guess I've always misunderstood the meaning of deadline. If I'd known that I wouldn't have pulled that all-nighter years ago finishing that final piece for uni - I'd have just gone to bed and told em they'd have it sometime in the next six months or so (if I got round to it)

You mean you never used the ‘extenuating circumstances’ line to get an extension?!

The problem is in all of these scenarios it’s the fans that pay the price.

The EFL needs to have a mechanism where the ‘golden share’ is removed from owners if they aren’t meeting certain criteria or go into administration ie the owners are just custodians if it. The EFL then runs the process of finding a new owner that can meet the ‘fit and proper’ criteria (for what it’s worth !) and offers best price. Whatever they recover for the golden share then goes back to the owners or the administrators. unfortunately, I’m not sure even this it would resolve the Bolton situation (from my limited understanding) and if it’s done without agreement/retrospectively it will just lead to legal actions etc etc by club owners.

I wonder if they could try to make all owners sign up to something like this in future though. Something has got to be done as the current situation is a mess and the EFL is toothless

Trouble with that is you've got something similar to the US franchise system

And the previous owner demolishes their stadium and builds houses on the site, using contracted players as labourers.

Trouble with that is you've got something similar to the US franchise system

I’d rather that than the current situation. I’m not talking about new owners having the ability to take the clubs to alternative locations (not that it stops some current owners !)

My idea is full of holes/loopholes that would need sorting but the alternative, as we are currently seeing, is dodgy owners driving clubs out of business. The EFL needs the ability to intervene earlier to stop these situations getting to this point

Do you really think anyone potential owner would buy a club on that basis

I just don’t get the hysteria - businesses in other industries collapse all the time - the fact these are the first in the league for a long time suggests the current system is working surely

EFL are becoming a circus now, I wouldn't want any club to go out of business, but this is really starting to take the piss.

People keep feeling sorry for fans but what about creditors who will not get a penny out of this - many who will be mall and faithfully carried on with helping the club

Bolton has been an utter basket case for 7 years - in any other industry it would be shut down. Bury made absurd financial decisions years ago and the only reason Dale is there is the ridiculous mismanagement before

No responsible company will buy these basket cases

A couple of years ago I would have said the writing was on the wall but nowadays we are run so much better and are nowhere near the basket case that sadly Bolton and bury are
We don’t have a stadium to play in in our home city, I’d say that’s pretty severe

People are confusing two things, the rules of a competition and company law. The EFL can't override company law so the sort of changes people are talking about would require the law changing to create a new category of business that doesn't abide by the same laws everyone else does and can go bust every few years with little to no consequence.
