All quiet on the Ricoh front? (2 Viewers)

What is the latest guys?

Last we heard was 4 days ago when obviously the FL cared to share their findings and results and not a jot since. Is this deliberate and talks are happening in a locked room and only come out and tell us when a deal is reached or are they simply not talking at all and this saga drags on weeks/months more?

I really had hoped for a Ricoh return for Saturday against Sheffield United which would be a great game and atmosphere but seems like if it was to happen then it was needed to be announced Friday or the Weekend. Here is to hoping.

But could the JR be dropped as part of moving back to the Ricoh?

Yes it could, but Seppala will not do that, the bigger question is will she pay the full £471,000 to ACL ad demanded by the Football League by COB on Thursday, I somehow doubt it then see what sanctions will be applied by the FL

I think she has to pay it now not legally as has been discussed at length but for the team as they don't want another points deduction which would be inevitable if she didn't pay it this time, not that care about the club but they obviously don't want a points deduction again as TF was fuming last year.

Its best that they all keep very quiet about what might be going on.
Those who know things should keep it to themselves till it's all signed and agreed.

The JR is over, if you mean an appeal, that might be put forward on Friday but at this point there in no legal action agreed.

Sorry I did mean the appeal, I just thought that dropping the appeal could be part of talks and at least it could solve things faster perhaps. I don't see why it couldn't be dropped if a deal was reached.

For me if we kick off at sixfields come Saturday then we will be there for the season I think.

Firstly, they can only ask to be allowed to appeal which means very little.
You may or nay not be right about any sort of action might slow down negotiations but let's try and be positive.
We can change grounds at any time to go back home, but once they go back they cannot switch again mid season. So lots to be agreed and confirmed.

I thought the judge said they couldn't appeal?! I get lost with all this JR nonsense!!

That is right, however they can ask the Appeal Court to consider the case, but they will provably back the Judge, next stage is the European Courts, that then gets super expensive.

Yes I take the Judges comments. He said yes sisu can ask for appeal by the court of appeal but he said he had "no doubts" it would be rejected which frustrates me even more as if sisu did decide to appeal then we have already been told 99.9% it wont be successful. I think then SISU have to accept the judgement or was it then they could go to European law and then accept the judgement? Of which all costs time and money of course.

Get back to the Ricoh asap.

It's been in am escrow account for two weeks so there is no reason why it shouldn't of been paid already.

It probably has been paid. If talks arnt already going on its probably because Friday is the deadline for the appeal and ACL are waiting to see what Sisu`s move is.

We'll be back at the Ricoh (albeit temporary) within weeks, maybe just 3 or 4,

As I understand it sisu have two options if they want to press on with their JR.

1) They can request the court of appeals to consult the EU court in Luxembourg.

National courts frequently deal with questions involving EU law. They may then
face difficult questions of interpretation of the relevant EU law or even have
doubts as to the validity of that legislation. In order to have a uniform
interpretation of EU law all over Europe, the Treaty allows national courts to raise
such questions to the CJ. Such requests by a national court to the CJ are the
"preliminary ruling requests". With regard to COMP activities, this may be for
instance a question on the interpretation of a Block Exemption Regulation. On
average, in the State Aid area, there are around 5 preliminary ruling requests every
year.

2) They can appeal themselves directly to the EU court:

Judgments of the General Court can in turn be appealed before the CJ by the party
that was unsuccessful, in whole or in part, before the General Court. The
Commission may be the applicant if it has been unsuccessful before the General
Court.
Such appeals are limited to questions of law (the CJ does not decide on the facts
of the case again). A significant number of General Court judgments in the
competition field are appealed before the CJ every year.

youve said that about 10 times now so if you keep saying it you will end up right in the end?
By the way where is the new ground you promised would be announced months ago.

You make out you know this and that but you are just full of shit.
By the way some have had a meeting with fisher this week so know a damn sight more then you.
This however is not the place to anounce things prematurely.

Otium having said publicly they will comply with FL I seriously doubt it, but with these people nothing shocks me.

There is no prospect of any talks till it is confirmed the JR is dropped..

I'm not sure that SISU can appeal directly to the European court themselves...

http://en.wikipedia.org/wiki/European_Court_of_Justice#Overview

But if they make it to the Court of Appeal (which isn't guaranteed) then that court should refer the case if the EU law is not clear...

http://www.richardbuxton.co.uk/v3.0/node/51

I think that interpretation of clarity is left to the judges in the appeal court. If they refuse the appeal, or come to the same judgement and consider the EU law sufficiently clear in this case, then I think that's finally game over for SISU.

I think they will pay the money the FL have ordered them too but I seriously doubt they will drop the appeal, they will go through every single possible avenue to prolong it further.

I don't doubt you but why prolong it? What do they achieve by doing this? Nothing IMO.
