Think it needs to be cleared up.
It could well be that it was asked "Has Tim Fisher been to see you to discuss a new football ground in your area" and if it was Steve Waggot or a 3rd party then they can quite clearly say no.... Same as "have CCFC approached you about a football ground" but CCFC have only approached about buying land and haven't asked about planning yet and stuff it could still be classed as a "no".
Need to pose the same question but this time under the guise of India Realty ,Fishers latest Entity .

happens all the time when private companies deal with local authorities or the govt.How would they reply with that? Would they just say "sorry we cant because of confidentiality?".
If that is the case, I'd just get the staff at the CCFC shop to phone all the councils to ask a question about buying land but say shhh its confidential

The requests asked whether any discussions, meetings or correspondence had taken place between the Councils/Police forces and Coventry City Football Club, its owners, agents or anyone acting on their behalf relating to the development of a football stadium and/or any facilities relating to the business of a Football Club.
All of the Councils have now replied to say that no such discussions, meetings or correspondence have taken place. regarding this matter

I write further to your FOI request dated 25th November 2014, in which you requested:
i) the terms of the agreement relating to the takeover of ACL Ltd by Wasps Rugby Club;
ii) what annual payments will be due to Coventry City Council from the takeover in respect of any rental or lease agreement and whether there are any conditions to trigger such payments;
iii) do Coventry City Council have any ongoing costs associated with ACL or the Stadium complex;
iv) What are the annual rates due from ACL for the stadium complex.
You also asked that of the above information could not be provided, when it would be made available.
The information requested under questions i) and ii) is exempt under section 41 of FOIA (as it relates to confidential information provided during the course of the Council’s commercial dealings). This information is subject to a confidentiality agreement between the parties. To provide the information requested would constitute a breach of the confidentiality agreement, which could give rise to an actionable breach of confidence against the Council in respect of consequential commercial losses. As this is an absolute exemption, the Council is not required to undertake a public interest test.
The information requested is also exempt from disclosure under section 43. Disclosure of the information is likely to have a prejudicial impact upon the commercial activity to the other party to the transaction. It is also likely to prejudice the Council’s commercial interests in that disclosure of such information may deter other commercial organisations from doing business with the Council. The public interest in withholding the information outweighs the public interest in disclosing it.

The Council cannot confirm when the information requested in questions i) and ii) will be made available (if at all). An assessment of whether information can be disclosed or if it is subject to any exemptions under the FOIA is made in respect of each individual request for information. The applicability of exemptions will depend on the nature and extent of the information requested.
In respect of question iii), the Council does not have any on-going costs still associated with ACL or the Stadium Complex.

Maybe looking at the answers would be more interesting? We have the precise wording for the question, but not the exact answers.

That is pretty much it. In reality you have to read between the lines. If just before Wasps bought the ground you had asked "are wasps in talks to buy" they would have said that is confidential. Had you asked "are London Irish in talks to buy" they would have answered no.
So really if the answer is that its confidential then that means yes.

How accurate is a request to an FOI? We already had CCC make an error with one, how well are things checked?
For example if Fisher has had a casual conversation with someone at Nuneaton Council is that even recorded anywhere. From CCC's dealings with both SISU and Wasps it seems very little is actually recorded, official council meetings not having minutes taken for example. If thats happening how is it possible for the person fulfilling the request to be sure no individual has had any contact with anyone in any way related to a new stadium build?
Couldn't they just do as CCC did and claim it was an error at a later date if they didn't want anyone to know now?
