Hmmm another needless day of costs and time.

Basically for anyone who doesn’t understand Sisu want wasps to pay another 29 million to the council as they massively underpaid and then claim millions in compensation off the council for damages the transaction has done to ccfc.

I think that’s right.

Judge Irwin says there is a ruling that the parties must seek mediation.

He says: “There is a long standing relationship between the parties, there needs to be working relationships in the future, it seems to me desirable that all parties go into mediation seeking to resolve all of those disputes relating to those relationships.

“That would include any future civil proceedings. It would be futile to enter meditation without considering that.

“By the end of the mediation process, if it is successful, all parties should be able to walk away with all issues resolved.”

He adds: “This is a case crying out for an honest attempt at mediation

It does need somebody to bang heads together and say to sort everything else out between themselves and mediate. I didn't know these judges could force that though?

The problem with mediation is, the council have no money, Wasps have no money and both will feel they've done nothing wrong and should pay nothing.

Whilst Joy thinks Wasps should pay the council £29m and a good chunk of that should head there way in compensation...

I can't see either Wasps or Sisu budging...

They're trying to imply the lease extension is equivalent to CCC selling Wasps freehold of the land, they didn't because the freehold still lies with CCC.

That’s why I don’t get why they’re pursuing this angle. They’re pursuing it in a court of law, the law will deal in factual law not virtual law and factual law is no freehold has been transferred. It’s still owned by ccc. I would think that their case would fall down on that alone before you even start to argue the merits of whether value was received for the tax payer.

CCFC QC now speaking on mediation.

He says: “My client’s position is that they are keen to participate, as they did in 2014. They will have a mandate to participate.

“Our priority is that the council and Wasps should have mandates to participate.

“If Coventry is to have a thriving football club there needs to be alternative stadium, like in Brighton, or an arrangement with Wasps, like in Swansea.”

Judge Flaux asks: “How are you going to mediate a new stadium?”

CCFC QC says that’s to discuss with the council. He says: “Clearly there are planning issues and so on.”

He’s also asked for a strong, independent mediator to be appointed.

Will be interesting to see what comes of that.

Sisu need these JR cases to force information into the public domain. Once its out there it can be used in a civil claim.
These are just fishing expeditions for the main money making event.

I also think that if the day comes that they have to admit they fucked up buying the club they'll have to demonstrate to their investors that they explored every avenue possible to claw back some of their cash.

Given that SISU have been granted permission to amend the appeal and submit new evidence, I'm sure they will feel pleased with today's work. They couldn't have asked much more. I also wonder if they want to use mediation to force a better rental deal and on a shorter term??

Whatever happened to the plans and new stadium that will only take 3 years to build in 2013?......................... Oh yes! that was nearly 4 years ago wasn't it?

So the judges think mediation will work......shows how much they've been following events. For SISU, the legal process is merely a means of breaking Wasps and acquiring the Ricoh for as little as possible. They have no interest in a mediated agreement, only the outright victory that winning the legal case could bring them. Total waste of everyone's time.

Depends how much of an eye they keep on it, if they are setting deadlines etc they should really be keeping tabs on it. (Judges etc)

Don't hold your breath. As above, SISU's only route to what they want, i.e. a load of compo and Wasps folding, is through a total victory in court and this won't be reached via a mediated settlement. Expect everything to proceed as planned in May.

To be fair, Mediation worked a few years back, albeit, Wasps weren't in the picture at that point, just CCC, ACL and CCFC. We need to get that Reverend fella back into the fold.

And now the CCFC QC has confirmed they'd mediate as per the judges request, they just need to sort out a time and location now. Simple.

Fortunately Appleton won't be available he is still on his lifetime quest "search for the golden share"
He was last seen fighting pigmi tribes in borneos rain forests.
Once he has found the share he has aspirations of a book and making a movie.

Was thinking that when it came up that Wasps and CCC both welcome mediation. Sure the last time it was mentioned they both said no.

I think CCC said they had no problem with it, I didn't see the Wasps lawyer mention it?

Hopefully none of them can back out if the judge is insisting on it.

Exactly. Sorry if I am uninformed or seemingly over-cynical, but I do not see how a mediated settlement is in SISU's interest, and therefore I expect them to come up with a pretext to take this circus on to a full court hearing in May.

Of course they can't force it, but not sure it would look good if they go back in May and a party says they backed out of it?

I think they (SISU) are hoping for a payoff but it does put the onus back on there being a good business relationship. Well, this volcano is dormant till April.
