I have done a lot of work with commercial contracts and in my professional opinion can advise, trying to be independent, that as long as the judge doesn't get too bogged down in the "who said what to who" nonsense, he/she is likely to look at the broader picture of a council trying to prevent one of its joint venture investments being broken and taken over by a hostile tenant as sufficient justification for taking of the bank loan and judge this to be legal.

It is an irrelevant remark, no club without full access to revenues has ever succeeded -- clubs who have had periods of instability and been moved away from its base have - as long as they return and get full revenue access -- e.g. Brighton.
