JR Decision Appeal ? (1 Viewer)

As Ann Lucas states this is all a complete waste of time and money. The only winners are the lawyers and we need a realistic way to get ccfc back home not this load of crap.

They tried to get their investment back with a unbelievable move and it has failed badly so forget it and now come home even though some don't even want them back home under sisu. I believe it should be ccfc back home and ten sisu out can wait.

All appeals it seems will be turned down until maybe finally someone listens or go down another route . It's obvious they have lost. Admit defeat and the sooner you admit defeat the quicker you can move forward.

Investors must be pooing themselves but maybe ccfc is a debt ridden company they are using to offloads debts. I still think they are asset stripping myself and getting ready to leave.

They are not a stupid company. They must know ccfc is a lost cause and the court case is "hopeless" so they either build a new stadium or come back as low rent tennants. option number 3 is to liquidate the club but to me if that was to happen it would of been done by now.

Way forward as we all know and said time and time again is to come home on a low rental short term deal that doesn't increase ACLs value significantly with access somehow to match day revenues. As a result of agreeing a deal sisu drop any appeals and further action and relations start again. Fans will come back as it's well known as sniff of success and ccfc fans will always turn up. Me included. They have the Wilson and Clarke money. Invest in the team infront of a Ricoh crowd and make a serious push for promotion. Pretty please.

The march on Saturday, the football league and protests outside places are all pointless and a waste of good efforts and money. Such a shame all this but it will end one day.

My only hope is TF said he wants peace and reconciliation. He has never said this and wouldn't say this if he still wanted to continue at sixfields as no point. He also said Joy is bonkers. He knows the score he just needs to do it.

Come on city. Let's all come home.

Fisher said SISU "batter people in court", these appeals are a last attempt to get off the ropes as the high court have delivered the "knock out blow" to SISU.

Did CWR say if the appeal on behalf of all original claimants? Is Arvo still there.

Probably a bit like the council not prepared to enter discussions before and during JR process. Now Sisu will be saying to the FL how can we negotiate a way back whilst there is ongoing court actions. A perfect manufactured but costly excuse. Also probably drags out the process for another year...

Sorry John but do you know the timescale for a fact, or id it just an guesstimate off the top of your head?

In an educated guess looking at the previous Court Cases, and how the Court system works, I would hazard that it will be sorted far sooner than a year.

To be fair to SBJ, you've had a go at him for a non-factual guess, and then you yourself have given a non-factual guess...but yours is obviously a better one because you've put 'educated' before it

Ask Grendull, he knows. Loosing the JR was always plan A apparently. The judge fell for it hook, line and sinker.

It will, but as soon as the season starts the FL won't give a shit for another 9 months. So they only need to waste a month or so.

They 'won' nothing-they were just allowed to have a JR hearing with barristers.
Seems the judge who originally denied a full JR was right though eh ?

Not that I want an appeal to happen but the judgement was so damning for Sisu they almost are forced to, just to try and take some of the heat out of it.

However, if the JR really is 'a sideshow', it shouldn't stop people putting everything behind them and moving forward with offers, negotiations and, er, 'peace & reconciliation' for a return to the Ricoh.

We can live in hope, eh?

I tend to agree the judgement was so damning that they are trying deperately to get it watered down .

Accepting the judgement would can be viewed as accepting that their "commercial" strategy has been found to be the SOLE reason fo leaving Ricoh by "the establishment".

They might win the appeal, who knows?

After all, the original application for the JR was initially declined and then overturned on appeal.

There is no shortage of legal avenues for SISU to pursue. All the time spent doing so is time in which ACL does not get paid, so although SISU are nominally racking up legal fees, they are still pressuing ACL who might say "ok, call off the appeal let's do a deal"

I'm all with the 'peace & reconciliation' riff Rob, as you know. But you can't do that while one side persists in trying to take the other to court. You can't consider it a sideshow if it continues to threaten your business.

It also doesn't help when the other side piles in and starts insisting on stuff as the precursor to any talks mind, I'd accept that too.

I'm pretty sure that if the judge says no, they then appeal that decision.

Are you being serious here or are you trying to be ironic?

All they have to do to take all the heat out of the situation would be to stop all litigation and pay all monies due. They could then get on with negotiating whatever is needed.

Why was the judgement so bad against SISU? Maybe it is because it is the truth. It seems to be so. So what you might be saying is that they are going to appeal as far as they can as they just want to water down the judgement? :thinking about: They are appealing because they haven't given up on the plan. They seem to have admitted to not playing the game straight, but still say that it doesn't matter as the decision should be decided only on what is right and wrong in the eye of the law and not because of monies withheld unlawfully. They have worded it slightly better than the truth though.

they can only appeal the decision of the decision if granted to do so by the 3 law lords in London to which SISU must the appeal the decision

They are already expecting him to not allow the appeal.

Remember when Fisher said that they will take it to where three judges decide the outcome? This is the appeal that comes after the appeal they are doing now.

Correct - they can then ask the Court of Appeal (the "three senior judges" of Fisher's statement) for leave to appeal the JR verdict on technical legal grounds. Sounds like TF expects the appeal itself to fail and is gearing up for the next step.

So, what's the deadline for the appeal of the appeal of the appeal? (is that the right number of appeals?) The one with 3 judges.

There are no winners in all these court cases (baring the lawyers), only us fans are guaranteed losers as long as we're not playing in Coventry. The club is suffering the longer we aren't in our home city and the long term damage could be catastrophic.
