Well as has been said before, both Bristol clubs with local council support , have been trying since the early 1990's for new stadiums, so good luck with that. Fisher has already admitted that 3 years minimum is now 4, for his fantasy new stadium.

The council and the charity should not be running a stadium management company. Both are 'fettered' as they are accountable to the electorate and laws governing the council's actions, and to laws governing the running of a charity. They would both undoubtedly like to get out. I don't think they need pressurising to sell up. The problem is how can they legaly sell ACL at a price that SISU may want to pay and the land/ stadium ( not sure what SISU want in addition to the bowl ) as an 'unfettered' freehold? SISU , or rather, Joy, has said that she doesn't waste time negotiating. So, until that position changes, what can the council do? In effect, we must keep the pressure on SISU to alter their stance on negotiations in order that the council can legaly give them at least part of what they demand ( e.g. a long term lease at favourable conditions or a buy-in of ACL ). I agree that the fans should also pressure the council to see CCFC as an economic factor and as a marketing factor. A successful football club gets the city's name in the headlines - at the moment the situation is the opposite - we get the headlines, but negative ones - and I think SISU, especially ML, should stop digging at the city council every other sentence. Even if they hate the council, they do own a team called ' Coventry City ' and their customers come largely from Coventry or near by. They should not, therefore be surprised at people hating them so long as they continue treating the fans with contempt ( e.g. threatening to sue the Trust ) and comparing the council with North Korea. If it were North Korea, the council would be able to give them a stadium deal without any pesky objections from disident citizens.

They're not running it, they own it.

You don't understand what "unfettered" means. It's nothing to do with ownership, it's to do with contracts that are in place and legally binding.

A private company in the same situation would say the same things. In fact a private company would've told Sisu long ago to put up or shut up.

Not quite. They said they'd accept a long leasehold but that CCC would have to "sort out" ACL and other contracted deals. But yeah, you're right in principal they've said they'd accept a leasehold.

I do know what unfettered means. They want to own a freehold ( or maybe a long-tem lease ) without contracts with third parties ( e.g. Compass ) - hence 'unfettered'.

The council cannot give them that without paying off ACL etc.. The point is, a private company has only to think of itself. It would'nt be bothered, say, about regeneration of the area. The council has to think about such things as jobs, image, economic benefits etc.. I agree that a private company may have said 'the Ricoh is not for sale at the conditions you have offered, please take your third division soccer team somewhere else'. CCC cannot say that for the above reasons and because a portion of the electorate would be up in arms.

I also know that the council and Higgs own ACL. They also run it through their appointees. ACL will therefore follow the council line. That is a complaint that SISU have. There is a conflict of interest.

I sympathise with your frustration, because I'm living with it too. But as I see it CCC have budged and offered alternative deals.

SISU haven't even started to negotiate yet have they? Have they put anything on the table? Aren't they the ones who keep changing their PR and contradicting themselves?

The stupid thing Mark, if they had laid their strategy and PR out correctly they could have quite easily have had the majority of fans on board. But like most things they do they get it back to front and inside out.

Come on then. What else should the council do?

Before responding, consider these facts:

ACL is not controlled by the council. So they can't just liquidate ACL. I believe that the Higgs Trust could also veto the sale of the Council's 50% of ACL shares and vice versa.

The freehold contains leases held by third parties. In law, they cannot be broken without compensation. If by breaking those leases the council might be seen to favour one third-party, say SISU, over another third-party, say the Casino (or even ACL), their decision can be challenged in law - via a judicial review.

The council are obliged, by law, to maximise the return from any public asset they sell.

So, there's just a few constraints - off the top of my head. With those in mind, would anyone like to suggest how the council can move things along?

What is surprising is that SISU seem to ignore the obvious, that the council is legaly constrained in it's actions, especially as they, SISU, seem to know something about judicial reviews. I am also surprised that they continue to fund CCFC every year from AVRO and then pay ARVO, considerably less, money as interest back. It could be conceived as a sort of Ponzi scheme. Putting more and more into a black hole, but showing an investment with a decent return of interest in the books. At some time, however, the bubble has to burst - unless they get the, almost, impossible - a stadium complex with an unfettered freehold at a price well below market value. Building a new stadium could only increase the risk of a major disaster. Glad I am not an Investor in SISU.
