Hope nobody is drink driving anyway but there are a fair few random spot checks about and no doubt will be until the new year.

Pulling lots of people over for spot checks.

Well said HH! I've not seen any yet but have seen a few Tweets from the police who tweet regularly about what their doing. One earlier stated a driver had failed a breath test and was consequently arrested, but was stating it was last nights drink so even the ones who drank the day before arent always safe enough to be driving but still chance it! Daft if you ask me!

As a rough guide it takes about an hour to get a unit of alcohol out of your system-so anyone getting wasted probably won't be fit to drive till lunchtime the next day.

i may be wrong here but if the police pull you over for a random check you are within your rights to decline any checks or searches and there isnt much they can do about it unless you give your consent. If they suspect you of drinking though and state they smell alcohol or mention something about how you have been driving you cant say no.

I don't think you can refuse them

You can refuse to do the test but all that will happen is that they will take you to the cop shop to do it there, either way there's no "out"

the test can be done if they have reason to believe you have been drinking or if you cause a traffic offence (speeding, going through red light etc). But if not you can say no and be on your way

Anyone who refuses should be arrested straight away in my opinion. Why would anyone refuse if they have nothing to hide? If you drink - DON'T FUCKIN' DRIVE!!!!!

Because it is their right to? Maybe they're in a hurry to get somewhere and don't want to be held up for no reason.

Rule of law for me is, if I am driving I don't touch a drop.

Too many people gamble and think they 'should' be okay after 2 or 3 drinks over a period of a few hours. Well it's just not worth the risk. 'May be okay' just won't cut it with the police.

Don't gamble is the answer. If you are driving the most sensible thing is to not drink at all.

Do you have a drink at night then drive to work the next morning?

They say if you are average size, have eaten an average amount, average metabolic rate and have been drinking average beer you lose half a pint an hour. If you have 10 pints this means it will be about 20 hours after your first pint if you drink at an average pace before it is out of your system, and you are drink driving illegaly for 16 hours.

It's all a bit muddy though isn't it. Trying to work out how many you've had and when you had then and what you've eaten.

And the answer is no, wouldn't drive to work the next morning unless I had only had one beer and not late the night before.

No one should ever be in that much of a hurry to decline a breath test. Only reason will be is the driver has something to hide imo!

And I think upon refusing this could cause the polices officer to get suspicious and therefore have reason to believe said driver does have something to hide! So if anything if your in a hurry, you'd want to get the test out the way rather than prolong your stop!

I agree with HH! Refusal should mean an immediate arrest; irrespective of whether the driver is under or over the legal limit!

They have always been able to stop who they want. theres nothing wrong with them stopping anyone. But they can only search you/your car/do breath tests if they have a reasonable enough cause to do so. otherwise it is all down to you giving them permission.

I was in my lads car with him recently. They pulled him over and breathalysed him. He had done nothing wrong and test came back as negative. When I asked her she said they were stopping drivers to test them and didn't need a reason anymore. Also a bloke I work with got stopped at 5am on way to work and tested. He was also negative.
