If Holdings claim to have beneficial rights to the share, then couldn't the FL state that Holdings is also in administration as it was supposed to be CCFC that was placed in admin, hence the 10 point deduction??

not sure the FL has the power to force a company into administration. they could say, as they did with Southampton, that they will be treated as 1 entity, not sure if that would help us tho as that would give Holdings a claim over the golden share.

That would mean the whole club is available to purchase .:p

not sure it would, FL only has power over what happens in the FL. they could say they will treat holdings and ltd as one entity in terms of players contracts, golden share, points deductions etc but in a business sense legally they are 2 distinct companies. Would be surprised if after all this there is a change in FL rules to prevent this happening again.

Whichever way the FL go determines the Value for Sisu in Holdings, which illuminates TF's comments yesterday that there is no value in LTD,thats why there are 8 parties sniffing around LTd its then a face to face over Holdings .

the club was split or hived down in 1995. It wasn't split in 2012. What may have occurred is an attempt at rearranging how and where the trade and player contracts sit post 19/06/12. In a group situation that is possible except for a football club you cant simply transfer the league share on a whim. The league share carries with it the player registrations and the academy rights.

If that is the case, isn't it similar to this...

QPR faced a points deduction. If the player contracts are in Holdings but the registration in Ltd, would that be classed as a 3rd party or is the above news story more to do with the player contract and registration being in a 3rd party somewhere??

CCFC Holdings Ltd is the parent company of CCFC Ltd, so the defence would be its a different type of third party ownership. Holdings Ltd can only exert control over CCFC, not another club. Whether that defence would work, I don't know, but can imagine a lawyer making good use of it...
