No I agree, but I think the fines should be indicative of any losses or inconvenience.

Me parking somewhere for less than 5 minutes while someone ran into a shop and getting a £120 fine (with a kind 50% discount if paid quickly) is more than a little excessive.

If it was a £15 fine I would've paid it.

Perhaps that's the point if making it so high...they don't want people parking there anyway, risking a low fine....the potential of a high fine is meant to deter people from chancing it.

If you do have a legit reason ie shopping for over 3 hours make sure you keep ALL RECIEPTS because without them you got no chance of appeal

Fair point, but I think there's something in the law that it has to be a fair fine indicative of lost earnings...and £120 is a joke

They cant fine you hence its a penalty charge and its dealt with under common law. As its common law you are paying compensation to the injured party and as such any penalty should be proportionate. If you get 2 hours free parking and overstay by 10 minutes then you should pay for the extra 10 minutes that you've used. If you have 2 hours free they can't justify any more than 8% of the original charge which is nil anyhow!

As with a lot of stuff in common law ... it depends! There is quite a lot in case law which says that if there is a parking co that is appointed by the landowner to manage the ability to park by legitimate customers of the retail park, then they are allowed to make a parking charge (NOT penalty charge) which will pay for them to undertake this management. If it is too much, it will constitute a penalty and be thrown out. The trade body for parking cowboys states in their code of practice that it should not be more than £100. The Supreme Court has upheld the view that £85 is not extortionate, and this figure MAY include a profit margin.

You are not paying for damages or compensation, as this would only be for trespass, rather than common law breach of contract. The only people who can sue you for trespass is the landowner themselves.

It's not like parking on someones drive, these parking spots are for customers of the stores and I shop in the stores after the match, I live in Rugby so kill 2 birds with 1 stone by doing my weekly shop at the superstore after the match, sometimes I get my haircut before the game so will be in the car park for about 4 hours.

Gaz, I think you could be at risk if they did everything by the book. If the parking charge is £120, that might be excessive.

This is a service where, let's say you live near the Ricoh e.g. on the same street as the Cherry Tree, but are not a Cov fan and you're away for the weekend. You can sign up to this site, advertise your driveway as a parking spot, and people will come along and book it for a certain amount of money for the number of hours they need (provided their booking is within the timeslot you have said it's available). Equally, let's say you're looking for a place to park near the Ricoh, when this site is used more widely there will be loads of people on here, letting their drives out for £5 for a match or something, so you will have lots of options in terms of off-street parking.

This is quite handy when you're looking for somewhere to park in a busy area e.g. my boss uses it when he wants to park near a station but doesn't want to pay th extortionate station car park charges (and street parking not available all day for non-residents). Same with visiting the hospital - don't want to pay the parking charges and can't find free on-street parking? If you know when you're going, just use the map on JustPark to find a local driveway that's available for the timeslot you need. Worked nicely for me when I went to watch Arsenal a few years ago, the bloke was at home, had his resident's permit on his own car which he moved onto the street, clearing his driveway and I just parked there...meant I could drive to the game, he made a bit of money, and I didn't get fined or clamped.

Give it a go.

Yeah, but they won't do that if you have been shopping.

No way the Arena is going to alienate its customers.

I'd like to see anyone go for their weekly food shop at Tesco and go for a meal there and be out of the car park in 2 hrs.

My mate was told by the chaps stopping you as you went in that as long as he spent some money (unspecified amount) and kept the receipt he would be OK.

When I went in I asked whether I had to spend over £25, the chap said I'd get a letter and it would be explained in the letter, I tried to clarify whether I could park for more than 2 hours if I spent some money, but he just said to read the letter when it came.

I decided to park outside the zone and just walked the extra 20 mins.

A guy was waiting for me and I had the fine on my windscreen. Researched it and decided not to pay it. Didn't hear anything for months but have recently started getting collection letters through my door, and they're asking me to pay £160. Don't think that's a reasonable cost incurred for less than a 5 minute stay. Appreciate they will claim they are adding all the letter fees on this. I am naturally getting a little bit anxious....I think when it get's to a court summons I'll pay the fee....

Got done at the same place. Really sneaky, you have a public car park with a handful of spaces that are private and the signage is poor. The whole car park was empty and I paid and displayed thinking I was in the public spaces. Keep getting letters and keep ignoring them. If it goes to court I'll win so not arsed.

I live 4 hours away and don't come up very often, I usually park in the tesco car park and spend some money in Next, get lunch etc.

There's a similar retail park down near me, similar amount of shops, big tesco. Went over Christmas once, we were an hour in next queuing for the changing rooms and to pay, then went to do the weekly shop in tesco, we were in there 2 hours because of how busy they were, I got a fine, back then it was £120, reduced to £35 so I paid it, but I've never gone back to those shops. You can easily spend hours in the shops at the Ricoh

Speak for yourself...five minutes in and I'm looking at my watching wondering about zooming into town to go to White Friars. Maybe you could escort Mrs Oucho around the Arena Park shopping centre if your tolerance level is that high, I'll get you a beer at a game if you step in on my behalf!

I like food shopping. I hate queues at the tills, but am very happy whizzing round the aisles buying stuff.

It's very rare we are less than two hours around the Arena shops. We go to Tesco, and usually Decathlon and Pets at Home and always into New Look.

I don't mind food shopping but I can only go to certain people to serve me, they must have clean nails,don't talk too much especially about my choice of bog roll and hopefully be you blonde and something to look at.

Christ, two hours at the Arena shops....no wonder you're such a passionate City fan, you clearly have a high tolerance to boring, un-glamorous and unrewarding uses of time!

If Tesco and the other outlets on Arena Park start getting lots of complaints that people are getting charged £120 for overstaying their 2 hours while using the shops legitimately, and risk losing business as a result, they will doubtless have to come up with some other way of keeping the Ricoh traffic out. But if it says 2 hours, its 2 hours for everyone, no matter what their reason for being there, unless it says any different on the signs. A better way of doing it would be a pay and display, with ability to claim back from customer service counters in the shops if you use them. But that will cost them too much to implement, and still how do you police people who pop in for a paper and a batch then go to the footy?

The FarGo issue sounds like your defence could be inadequate signage, but there's loads of loopholes you can exploit!
