Playing at the Ricoh looks increasingly less likely again.
I think someone dropped the ball here somewhere...a lawyer for SISU I suspect.
Lets think about it for a moment.
SISU drop the legals so they can have talks and get a deal at the Ricoh. Time not on their side.
At last we shout...thank goodness for that!
All seems to go well until a leak comes out about the EC complaint back in February.
Now if said lawyer for SISU put the complaint in and never did enough due diligence to suggest it can not unilaterally be withdrawn at any time then the mistake is made.
Chances are SISU understood they could simply withdraw it and would if WASP were going to enetertain a new deal. As such they entered the talks in 'good faith'.
Why would they enter a new talks of a deal only to find they could be in breach of its terms if they had no control in withdrawing the EC complaint?
They faced potentially being kicked out of the Ricoh immediately by WASP for breach of contract resulting in no ground mid-season! No ground share deal mid-season! Not something that could be rectified between fixtures to fulfill.
Now WASP and SISU need to compromise on how to deal with it.
I doubt SISU will sign off on compensating WASP should the EC and any legal body there decide WASP did receive state aid beyond legally reasonable.
A rumoured possible 20m would bankrupt WASP of course and SISU would not have that kind of money to simply hand over or even consider for nothing in return.
So there's the impasse. How do you get out of that? Can either side agree to not accept any ruling from the EC action? I doubt it.
The risk to WASP is a huge one.
The reality is SISU have every right to pursue every option to them regardless of what we football fans think for the life blood of our football club.
Now the EC ruling is to investigate, there is that possibility for an ultimate ruling in favour of SISU (or not)
That would throw WASP out of the Ricoh potentially and open up the whole sorry sale go round again with SISU hovering like a wounded animal.
The council in their infinite wisdom to bite back at a despicable hedge fund company, invited and sold the Ricoh on the cheap with a massive extension to it's lease to a out of town Rugby Club looking for a new ground, knowing the football club was an institution to the city and owners of such institutions will always come and go.
All of SISU's cantankerous attitude deserves nothing but contempt for the most part, but when you strip it down the real villain of the peace has always been the council and it's idiotic approach from the very beginning.
Unless WASP can find a solution that entices SISU back to talks I fear SISU will look for that ground share and leave WASP knowing there is one potentially game changing decision still to come down.
Of course if we leave the EU which will happen, the question is when and if any ruling from Europe can have any effect before Brexit or after Brexit on this case.
