Hi Folks

I am looking for anyone with any legal knowledge who could perhaps advise or willing to help me. This is a very brief synopsis of the situation I find myself in.

While living abroad I have attempted to take some-body to court. A fter a telephone hearing the Judge decreed that there was a case for the Defendant to answer. After the hearing date was set the defendant requested an adjournment as he would be out of the UK, I subsequently requested from the Court what action I should take. Despite my request I heard nothing until eleven weeks later when I was informed that the hearing was going ahead twentfour hours later and to arrange yet another telephone hearing.

I later discovered that the Defendant had been notified three weeks previously that the hearing was to proceed as originally decided.

The judge ruled against me on the grounds that I had not arranged the telephone hearing, he also stated that I had not submitted my monetary losses, these had been submitted to the Court six months previously and after a complaint to the Court they admitted that they were in possession of them but it was not there responsibility to ensure that the Judge saw them.

Presumably you can appeal whatever decision the court makes.
To do that, you really need proper legal advice, which will cost you money.
So you'll need to balance the cost of appealing against your monetay losses.
Are there any lawyers there who work on a contingency basis?
i.e. they don't charge you, but they take a percentage of the amount recovered.
I think they normally only take on cases where the amounts are substantial as that makes it worth their while.

Normally you can get a judgement set aside but not sure on the time scales for this. If I were you I'd speak to either citizens advice or a solicitor to see what your options are.

That is why I have put it on the "Off Topic " section, ie.not football.

No one is going to be qualified to help though even with some legal training unless the full facts are presented.

Some solicitors offer free initial consultation and citizens advice may put you in that direction.

Don't get legal advice from a football forum, whether it be off topic or not. Of you do wish to use such forums, it might be better to target your search a bit better and use a forum such as money saving expert, where at least the CAB monitor threads. Alternatively, contact the CAB directly.

The reason I posted by question on a "Football Forum" is that there some highly intelligent supporters out some of whom may be a solicitor.
The CAB cannot help and will only offer you a list of solicitors.

I would recommend the Consumer Action Group forum. There are a LOT of very knowledgeable people willing to provide free help. You could certainly get the case set aside as the court may not have followed the correct process (based on what you have told us).
