It could be seen as protecting their business (ACL taking action against NTFC) which would be the directors responsibility, and they'd be negligent if they didn't.

So you concede that ACL's business model is fully dependant on the football club being there?

Presumably ACL are saying NTFC have to compensate them for loss of earnings on the rent contract they hold with CCFC Ltd.

It still has 40 odd years to run, it hasn't been broken & no agreement has yet been signed to reduce the rent below £1.2M p.a.

Well, NT's fans are least deserving of being sued. However, David Cardoza?

Sure he's a smarmy cock, but still he has no responsibility to us and so is doing whats best for his club, I don't like it but I don't think he or they is anywhere near on the level of SISU or the Football league in terms of the moral crimes they have committed.

Yes we are a pantomime and a joke. The biggest joke is we will also certainly end up back and the Ricoh and this has all been for nothing.

I think I'm on my own here but feeling sorry for NTFC in this. They got asked a question and said 'Yes'. That (as far as I'm aware) isn't a crime. So they pocket cash out of it...if it was the other way round, we'd expect some cash (ironically for rent).

Unless the NTFC approached the club to say 'hey, come and play at our gaff', then they've done absolutely nothing wrong and I don't get why we're showing such animosity to them, their chairman and their fans.

Another example of embarrassment for all parties involved in this mess. ACL making themselves look as foolish as SISU on this one in my opinion.

I think this is a concerted effort to keep SISU from moving the club.

Think about it. They could sue the FL but SISU would still move regardless.

Sue Northampton and you add to the already large worries the police, fans and town already have about this.

Add in a court case and suddenly your turning mild worries into "RED ALERT" warnings.

I wouldn't be suprised if Northampton Town did a youturn and said they wont allow it as long as ACL retract their court case against the club.

This could force SISU to play at the Ricoh or risk losing their league status and being plumetted to the bottom of footballing society!

never like to see fans dragged into things but Cardoza had plenty of warning it was a bad idea getting involved but thought he'd pocket some easy cash. no sympathy for him at all.

I have no sympathy for him either but I do for their fans and so I'm not really keen on it, glad ACL are doing something but there are much more deserving targets

Not at all, ACL are protecting their own interests. CCFC still have a lease to play at the Ricoh, this still exists IN CCFC Ltd. NTFC have 'stolen' their trade affectivly. SISU have fallen into a trap and it's just snapped shut. Well played ACL

I think a lot of things in life, not just football, are similar to what Cardoza has done. Like people on here moaning about City leaving Coventry then in the next breath saying we should move Nuneaton into the Ricoh. I bet Cardoza would be blowing a gasket if the shoe was on the other foot, but because HE and HIS club benefit then suddenly, all is OK.

Suing Northampton Town could be the first step towards targeting the Football League.

That of course, is possible. Or an oblique way of targeting the League as they, presumably, will be called upon to assist in defending one of their members.

Well now ACL show that they are prepared to use litigation.

Why is everybody on about their fans? All I have seen is they don't want us there anyway, so they are with us on this one.

The strange thing is now.

If SISU do get back in at the Ricoh they will potentially be around longer holding out for an over valuation of the club.

If they go through with thd hair brained scheme they will be gone sooner....

I don't feel sorry for NTFC one bit don't wish any harm on their fans but their chairman has used our situation, a fellow football club and apparently a mate's club to make a bit of money, will it go to the club I ask ? and IMO has half an eye of gaining supporters off City from the Northamtonshire area. If we get over this delema I would offer anyone from Northampton and the local area half price season tickets to ditch the cobblers and come over to us.

No I didn't say (and haven't ever said) that at all, what I said was they have to protect their business in the interests of the shareholders who are the owners of the business. If you poach a client of a firm who has a legal contract with them then the directors of that firm would be failing in their duty to the shareholders if they didn't take steps to recover the cost of the contract. They would leave themselves open to legal action if they didn't.

They have allowed a club to move to another stadium when the club has a long term contract at their current stadium.

We don't agree on everything torchy, but I'm right with you on this. If ACL did to another club (football or rugby), what Cardoza has done to us, then they would deserve our utter disdain (imho). Just because you can make a few quid out of something doesn't make it right.

The lease is still with CCFC LTD which still exists so therefore the lease still exists too.

By moving to Northampton they are breaking the terms of the lease, therefore allowing ACL to sue Northampton who are willing participants in this breaking of the contract!

The fact CCFC LTD is in administration doesn't mean the lease is broken.

The only way they could break the lease is by liquidating CCFC LTD...

The Chronicle & Echo understands Northampton Town FC has received a letter from Arena Coventry Limited (ACL), the owners of the 32,600 stadium, threatening them over plans for the Sky Blues to play in Northampton over the next three years.The proposal was “reluctantly” ratified by the Football League this week.The move is likely to cost ACL millions of pounds in lost revenue, should the move by completed.More to follow...

As it goes, you can sue the FL. Stevenage did. They lost, but what the judge said was quite telling.

As I read it, I think that you would need to argue that the FL rules were arbitrary or capricious, or that they have been applied in that way, to stand any chance of success. My gut feel is that there might actually be a case to answer against the FL on that basis, but perhaps there's a clearer case in law against NTFC. ACL won't have taken this action on a whim, imho, they must consider that they'll have at least some chance of success.
