Perhaps the recent offer from ACL seeks to answer this. After all, if SISU did win the JR and then sought to pursue an additional action for damages - it would seem a pretty good defence to say - you had the option to come back rent free but chose to stay at Northampton for your own reasons, so (putting it mildly) you did not take action to mitigate your losses.

As has been said an offer has to be made and one that isn't derisory and gives a reasonable deal for the people of Coventry. Doubt there would be a sale during the legal action anyway.

Given that SISU are happy to spend £25m on building a circa 16-18,000 capacity stadium, logically they should have no problem in making an attractive offer to buy the 32,000 capacity Ricoh.

His conclusion that that Sisu/Otium are going to use the JR to seek punitive damages from CCC/ACL for loss of income seems to based on comments made on here.
This article will then be used to back up comments on here that Sisu/Otium are using the JR to seek damages from loss of income.
So it goes round and round, supposition and hearsay repeated enough becomes truth for some, and nobody gets any closer to knowing any reality.

Sadly scraps of information and half truths seem to be all that we have to work with.
For me, the issue is that Sisu/Otium's business strategy makes little or no sense if taken at face value, consequently we are left to try to work out their "true" plans using the said scraps and half truths.
Or maybe it should be taken at face value and they are just very poor business people...

Wish that everybody involved could, just for once, play a straight bat.
ACL with the "Free rent offer", had a great opportunity for scoring an open goal, but it's just trickling over the line, but still not quite all the way in yet.
Why can't they make any offers direct to Otium? This one through the Football League, the last one through the administrator, just leaves wriggle and obfuscation room for Otium to use.
Make whatever they are offering direct, all aspects of it, rental, lease lengths, match day cost, any F@B etc, all clear to all.
Copied to the Football League,media etc, so everybody knows what is being offered, and any responses from Otium also plainly distributed.
It's all still smacks a little of game-playing, and think we're all fed up of game playing, especially when it's not at home!

Yep, I posted yesterday that whilst I could completely understand copying the offer to the FL (and to anyone else they could think of), it would have been more sensible to make it directly to Otium.

No idea if he has a username on here, I assume it's the same guy who phones CWR saying how glad he is we're at Northampton because there are no negative fans there and it's easy to get to! It's almost as if he rubs everyone's nose in it who's not going.

If everything they've done is all part of a negotiation strategy to reduce the rent, it's worked very well! They've bargained ACL down from £1.2m to zero if the stories are to be believed.

I can see your point, but actually I think making the offer through the FL is quite smart. Otium can't deny it's been made, and it makes the FL clearly aware that there's a reasonable offer on the table for the club to play in their home town.
Personally, I think that puts both Otium and the FL under a little pressure.
With regards to matchday costs, I don't know if the £320k is fair or not. It seems that just running the undersoil heating can cost around £10,000 a week (http://www.pitchcare.com/magazine/counting-the-cost-of-undersoil-heating.html), so another hard winter would probably see fuel bills in the region of £100k - £150k or even more perhaps. Then there's the cost of the groundsman and staff etc. before you even get to the front of house operations.
Of course, as mentioned elsewhere, an extra 10,000 on the gate for each match takes care of the £320k within a few games.
Clearly though, it's not about the rent - there's no figure that Otium will accept.
It doesn't hurt for the FL to be aware of the fact that there's no financial reason (other than the continued distressing of ACL) for CCFC not to be playing at the Ricoh. It might, I suppose, affect how long the FL will support the club in their current stance, especially given the clear lack of plans for a new stadium elsewhere. Truthfully though, who knows!

No I'm saying there isn't an excuse for party politics in this. I was putting forward the right wing view as to why, in this instance, the left wing council is right to stand up to them.
I'm sure there are some idiots like Pete Chambers who have some sort of agenda, but this is a cross party thing. The Conservatives haven't once criticised the councils handling of this to my knowledge.
