I am intrigued to see the excuses and allegations that will be posted on this forum if CCC lose the JR.

No danger of that sicknote, Sisu were laughed out of court yesterday by all accounts, even RFC has disappeared up his own arse.......

you saw it in the higgs case. i remember posters saying that sisu won the higgs case. no, they came away without their counter claim and had to pay there own cost and higgs came away without there claim and had to pay their own cost. thats a draw by any stretch of the imagination.

oh by the way, higgs took their claim to county court, sisu took their counter claim all the way to crown and the judge threw it straight out, their counter claim was also invalid. still a draw.

You also saw people cheering Higgs on like they were a football team to win. Like it was a last penalty to win the FA cup or something.

To be honest, while reading that case I was fully expecting Higgs to have got their money from reading it, turns out they didn't.

indeed they were. the OP i replied to suggested that excuses would only come from one section of posters should one particular party win. i was just re-addressing the balance in the interest of harmony, anyone who's been on here for more than 2 weeks would know there is going to be excuses posted whatever the outcome.

So the council borrowed £14 million against a company valued less than half that? Not a great use of state aid is it?

Higgs are only half of ACL. So only half of the loan is attributed to the Higgs share. But you either knew this or don't have a clue what is going on.

So you think that there will be a winner? The losers will be CCFC and us supporters. And whatever decision is made will be on technicalities.

I know that some have me as a CCC supporter. What a joke. I am on the side of Higgs getting most of their money back. They are a local charity that got involved thinking they were helping our club out. And now SISU are trying to rip them off with outlandish offers so their investors would profit. I don't agree with this.

So far I have seen CCC try to negotiate. I have seen SISU do whatever they can to devalue the Ricoh. They don't give a shit about our club or us. Why should I give a shit about them?

I just want to see an end to it all. I can have an educated guess on what is going on. But it is all down to Joy and what she can get for her investors.

But it could be argued that that local charity went outside their remit, as much because Sir Derek Higgs was on the board as the club failed. It's not like they just popped up from nowehere, and it's the kind of shuffle that if the Seppala charity foundation bought Ryton off the club to enable the club to continue, people would be up in arms about...

Just a thought... that perhaps in stopping the club going into administration by buying its saleable assets, it also helped maintain the board at the time's position.

Am sure PWKH will be along to correct me ;)

2. I think you are losing your composure. Rated you better than that.

3. Higgs' claim was not covered by the situation of both sides losing their appetite to carry the deal through. This was only ascertained in court when "all" evidence was presented. Higgs' couldn't have foreseen that and didn't when drawing up the agreement on costing. SISU's case was described by the judge as a "hopeless case". Nuff said.

To be fair to RFC, he answered my question about the JR with good grace and seemed to suggest there were some things he was told that didn't come out. Which is more than some who have suggested there is more info to come.

We are.

But there is a way of approaching it... that that board at the time had failed, should leave the club, hand it over to decent owners... and any short term influx of cash to help the cashflow and stop them selling up wasn't necessarily in the club's interests...

It's all in the perspective and how you choose to write the narrative.

The club should've gone bust long ago, and possibly still should (though Godiva's theory/idea about ARVO buying out the other investors gives me some hope on that front), but who wants to be the guy who let the club go bust? Which true City fans doesn't believe we're about to turn the corner? You can understand why what was done was done, even if hindsight is 20/20.

Which is why the club should be given a share of the cake. The valuation goes up dramatically due to one tenant who has paid thfor e whole mortgage for years and receive a very poor deal.

The council and ACL are in la la land if they think anyone will return purely on a rental basis when the club will have a massive impact on the value of ACL.

I don't deny that, but the club sold the F&B rights and now Compass are there. There has to be negotiations on that point, but starting a JR doesn't help. How can you do a deal with someone who is suing you? The tenant got itself into a mess by sloppy business and accounting practices - not the fault of ACL.

The council and the charity stepped in to keep the project afloat- not to go into long term business as a Rackmann landlord - despite what SISU may lead you to believe.

If the tenant had been a good businessperson we wouldn't be here.

But I'd strongly suggest there's a narrative that says certain members of the board (see! this is where I need to distance from the other posts for the purposes of clarity!) at the time were not motivated by thinking about the good of the club; there was after all a reason why Derrick Robins had to be tricked out of his shares.

Substitute Go SISU go for Go Robinson Go, expect them to leave and just write off everything they've pumped in because the club's more important than their investment, and they should stop trying to protect it...

Also, apologies for quashing your ARVO hope, but if the clock's set to zero there's a reason it's sold at a big discount, and that's because it's a massive risk, that anybody buying it is fully aware may go horribly wrong, but they're prepared to take that chance...

I'm not sure it's 100% either way. Richardson, McGinnity, etc. I can buy ripping the club off Higgs, etc. I'm not so sure. There has to be some genuine City fans out there and I'm not sure the Charity has done particularly well out of any deals.

Everyone saves the club for a reason, granted, and some more altruistic than others, I'll give you that. But they can't all be like that, leave me with some happy thoughts in the world.

I said: leave me with some happy thoughts. (I'm still not convinced that it doesn't mean that at least the acceptable loss is less than before. Though obviously you could argue that if the investors accepted that figure from ARVO they'd have accepted it from someone else. Depends on how highly you rate Joy's negotiating tactics I guess.)

He also sold his shares and (I forget which way round it was!) he explicitly didn't want Robinson/Richardson involved in the club, so the other party bought them... then sold them straight on to their colleague.

As I said, it's all in the narrative. To placade a lurking PWKH whenever he passes by, I'll happily point out when Derek Higgs died, his obituaries were big on his integrity within business which would suggest your narrative here is closer to the accurate one.

But it often seems a little lazy to say 'ripping off a poor charity' to me. As you say, if they haven't done well out of any deals, they were arguably ripped off by those you mention when they got involved... and thus SISU offering values that don't get their money back isn't SISU doing the ripping off, but those who were there before... while SISU coldly offer market value!
