Just to help out with clarity and everything: I think we should get to see the stenographer's transcript and the details of the arguments inc. referred to evidence if released at the end of the case so will be easier to follow everything.

The most depressing thing about this is that back in Aug 2012 there was the chance to do a great deal. It's easy with hindsight but I wonder how many people in this saga (CCC, Sisu, Higgs, etc) now regret not following thru? I'm miserable about it myself but then I'm just a Cov fan...

According to evidence and PKH answers, this was the conditional agreement on the table with the fine details being worked on. Lots of reference in court to indicative terms sheet (ITS) so look out for that on public disclosure of docs

Agreement was to be Sisu sort out bank debt, CCC extend lease, Sisu buy out Higgs share of ACL and AEG brought in by Sisu to manage arena

PKH agreed with QC that there were holes in the bilateral (CCC and Higgs) rather than trilateral approach to bank as didn't consider how it would affect CCFC

Now into bank approach deals. Sep approaches to Yorkshire bank. CCC on one side keeping PKH and Paul Harris informed but secret from Sisu whilst Sisu make their own approach. Higgs people no part of meetings but knew about them
