It seems that other (more junior) people who attended the event were fined, ergo, it's an event that broke the rules that were in place at the time, as set by the Prime Minister.
The photographs clearly show that the Prime Minister was present.
There is no condition that I'm aware of in the law that sets a minimum time of attendance at a forbidden event, below which one can claim to have followed the rules.
Here are the rules that were in force at the time, as set and outlined quite clearly by the Prime Minister literally eight days prior to the event.

I'd welcome an honest explanation of how one person at the event is fined, and another who is clearly present, is not. It certainly doesn't look like the Met are going to be able to provide one!
Regardless, he has already accepted that he has broken the law at another point in time, is it a three strikes and you're out rule for Government ministers now?
Im not excusing it at all, you and others might read it that way because I don’t get excited and start calling the Met bent (they might be for different reasons) and for them to somehow reopen investigations and waste even more police time because i want more FPNs issued
Im just trying to explain the polices position in all this and the challenges they face looking at stuff retrospectively. I also threw out a couple of examples of how one person could get fined and others not. I don’t know though, it was a guess as I said. They fucked up by not dealing with it at the time (as they are based at Downing St). They have not, to my knowledge, issued any fines elsewhere retrospectively. I just think the level of time and effort the Met and Durham are spending is a waste.
Just to be clear again, that’s not condoning behaviours. The Sue Gray report should’ve done the job and will probably be a more accurate reflection of the events (in a negative way for government) rather than the FPNs

And we had to turn people away from the funeral. She was very well loved and liked. She was a wonderful woman, but we could only have 30 at the funeral and everyone else was turned away.
The church wouldn't let us sneak in just one more. So not 31, 30 only and that was it. They wouldn't let us go over by even 1.
One very old lady turned up, who was a very good friend of my mum and she was the 31st person and we hd to turn her away.

If they deem that there isn't a case to answer, then I don't see why this instance should be big news, particularly after the same crowd suggesting Starmer and Rayner weren't at a party, despite booze, food and at 10pm no work done afterwards.
