Sky Blues chief executive Tim Fisher has insisted a High Court judge made the wrong decision after throwing out a judicial review brought by Sisu investigating the conduct of Coventry City Council.

He said: “Given the evidence and submissions we were very surprised by the judgment.

“We believe it is wrong in law and in fact. I have no doubt that this will be heard in the Court of Appeal in front of three very senior judges.”

It’s thought any application for leave to appeal will be heard within the next three weeks.

Mr Fisher now insists “Plan A” is building a new stadium for Coventry City Football Club – but didn’t rule out a return to the Ricoh Arena in the interim.

He said: “Plan A is to build our own stadium. We need to own our own stadium, it needs to be a normal football club with control of all revenues like all our competitors.”

He added: “In February 2013 we negotiated to have a three year run off at the Ricoh Arena while we built our own stadium. But we were told ‘no, that’s not a deal we will consider’.

“As part of those negotiations we looked at a League One rent, and control of all revenues generated as a result of the football club playing a match at the Ricoh Arena. We have to control those revenues. That is critical for Financial Fair Play.

“Nothing has changed. There always was an interim deal to be done.”

Mr Fisher would not say if he would proactively pursue any deal with Ricoh Arena operators ACL, but suggested the company would not be able to offer such a deal.

He said: “ACL has borrowed beyond all reasonable debt, so it’s challenging for them.”

And he claimed: “The debt burden on ACL means that no deal with any sporting franchise could ever happen.”

He also insisted any appeal against the judicial review ruling would not interfere with preparations for the new season.

Nothing exceptionally wrong with that statement tbf but worryingly for me is the point of it? What is the end game by appealing? I don't see even with a reversal that it would lead to 'ownership' of the Ricoh. SISU are not the only players out there should ACL go out of business.

I would prefer they set aside an appeal while negotiating a long term deal at the Ricoh. It seems they want ACL gone. But then what is stopping the council from restructuring ACL by disbanding it and reforming a new management company inclusive of the football club?
That's where efforts ought to be concentrated....

Bad: The intent to appeal and drag all of this out still further.

Good: Is that a tiny chink of light in the possiblity of at least a temporary rental deal with ACL? That's almost encouraging.

I sat through most of the 3 days of the JR, was present for the verdict this morning and have read the ruling in full. It is clear to me that, not only did Sisu lose overall, they lost on every single point. I haven't seen this big a thrashing since City lost 7-1 to WBA in the late '70s - at least City scored 1 that day, Sisu were lucky to get Nil in my view. Quoting one of my mates on Twitter: 'Joy Seppala, Mark Labovitch,Tim Fisher, Les Reid ... your boys took one hell of a beating!'

Contrast the Sisu response with Ann Lucas's moderate and conciliatory statement, offering the chance of returning the Club to the Ricoh. I hope that Tim & Co reconsider their position and the tone of their statements and grasp that olive branch. Just for once, please Sisu consider the supporters and show some humility.

The judge laid out clearly the rationale behind his judgement but did not stop to passing judgement on SISU 's business ethics or morals, they are what they are. In years to come if anybody asks for background on the history of SISU 's ownership of CCFC this will be where to point them.

He doesn't appear to have learnt anything from the court case and continues to denigrate ACL's financial status. However, they do appear to have a business plan, something that CCFC doesn't seem prepared to publish or discuss.

it doesn't seem that he will be seeking it and it sounds like his next step will be to turn down any deal with ACL as, according to him, they aren't able financially to make an offer that he considers acceptable. In that he could well be right, as I think that any offer ACL make will be too much, unless they are prepared to hand over the company, the pie and car park revenues...

Tim Fisher is a legal genius - a mind that comes along only once in every generation. He can assimilate facts and recall key cases at lightening speed. The only person who comes close to his acute legal intellect is Renaissance Man, athlete, glamour model and all-round hunk Ken Dulieu. It comes as no surprise to me that Tim was able to almost instantaneously assess the case and decide that the Judge got it wrong. I bet Justice Hickinbottom must be feeling pretty foolish now.

That aside, it's done... the council won.

Now if people want to sit there and crow at how amazing CCC and ACL that's up to them. Just remember that there actions were perfectly lawful, but hardly supportive of CCFC.

Both sides are at a crossroads - their actions from this point could ultimately define their futures. I hope that somewhere they will both realise and get together and put a deal together - even if it's just for 1 season.
