Just had this response to an email I sent questioning the player registration mess.

Nothing new, apart from they've obviously bolted the stable door against other clubs carrying on like this while washing their hands with us.

RE: Coventry City

Chris,

Thank you for your email.

The rejection of Coventry City FC Limited's CVA on August 2 meant that it was no longer an entity capable of fulfilling Coventry City's Football League fixture programme. This was because the club's assets had already been sold unconditionally by the Administrator to the Otium Entertainment Group ahead of the CVA being considered by the club's creditors.

Otium, as the only party capable of taking on the club's Football League share at that point, then made an application to the Football League Board under the 'exceptional circumstances' provision of its Insolvency Policy. Having considered the matter fully, the Board made an offer that was conditional on Otium accepting a 10 point deduction and agreeing to meet its offer to creditors under the failed CVA. This offer was accepted.

Without the agreement of the Board to transfer the share to the Otium Entertainment Group there would be no Coventry City competing in The Football League today.

In relation to player contracts, over time the ownership arrangements of Coventry City have become extremely complicated. The contracts of employment for Coventry City players were entered into by a different company to that which held the share in the Football League. Both The Football League and The FA registered those contracts, because The Football League effectively treated the two companies as a single entity and thus considered there to be no breaches of existing regulations at the time.

Through the Administration process this issue has been addressed. The League share and players contracts are now held by the same entity.

The League has reviewed its procedures and measures put in place to ensure that this situation cannot be repeated.

Thank you for contacting The Football League.

I think the issue is that had the FL not made this mistake the players and share would be in the company that was in administration. Given that most people would have assumed prior to this that the FL would follow their own rules they would act on that basis.

So, if the club's assets hadn't been sold, we would have been an entity capable of fulfilling games? (Although CCFC Ltd apparently didn't have any players of course....)

I still say that the Football League should have tackled this looming disaster in May when there was more time for a solution that would have been more acceptable for the majority of supporters, themselves and maybe even the two warring parties. They left it too late and then the only issue became the fulfilment of fixtures.

Yes, and no doubt whatever plans Sisu has for CCFC - merger, ground-move, franchise, liquidation or God knows what - will be presented just before a new season and the Football League will roll over again if there's any threat to their fixture list. Blackmail works.

So proof (again) that ACL didn't lose any money by rejecting the CVA?

And proof again that the FL fucked up and we are supposed to be happy because we still have a club in the FL.

I had a similar response. However, just because the Football League accepted this doesn't mean to say it wasn't illegal ?

If Ltd and holdings are one entity, they should both have gone into administration and the golden share and players contracts been up for sale in the admin process. It makes me sooo angry that it is clear what SISU did and yet the football league and the FA ignore the fact that creditors had no assets on which to claw back some of the money owed to them from Ltd. Meanwhile Holdings sit there all smug with all the club assets that they moved over (illegally imo) and no-one can touch them!!
