I can appreciate the theory about first time offenders being less likely to reoffend, but equally the gut feeling from pretty much everyone is that the punishment should be loss of liberty. It’s a tough one. So many sentences seem very low. Rapists and murderers of people I know have had sentences of around 4-5 years, which seems ludicrous for destroying someone’s life.
It does feel, all else being equal, that we’ve swung a little too far towards the data and away from the gut feel of justice and it’s that that gives the system its legitimacy at the end of the day.
