It would be pretty desperate for them to try and claim that as an excuse? Especially as it's a Wasps Employee doing all of the PR and interviews about it.
If a council CEO getting paid hundreds of thousands tries to claim he didn't know it was Wasps then he might look a bit silly.
Although if he says it isn't Wasps because of that technicality then it might be a reason to reject the planning application
