now it’s becoming a reality moving from the ricoh - Letter from EFL to CCFC (1 Viewer)

Because expulsion of a shareholder is likely to require a special resolution under the companies act which needs a 75% majority of the members and a relevant notice period.

The non expulsion after such a vote would lead to the obvious wouldn't it. Whether the club could survive that is a different question. But it gets efl off the hook.... integrity of the competition etc etc .....

Allows efl to accept things they said they wouldn't

What is the estimated maximum amount that Sisu could realise if the court case goes their way?

But it isn’t really IN the EFL court, there are rules and procedures. There are also 72 EFL members and if one or two complain to the EFL higherarchy a rule is not being adhered to the league are duty bound to act. Now if I was chairman of one of the three or four battling for league survival at the bottom of division two I’d be screaming for the rule book to be adhered to.
Wouldn’t it be ironic if Notts County and Michael Doyle were saved from non league by our demise due to all this.

Actually it requires a far higher number of members than 1 or two to throw us out

True, it requires atleast 54 and non of them would want to of that I’m sure, but it would take only one member to ask for a vote and I repeat if they don’t kick us out where do we play ?

Sisu playing hardball againt wasps who have a lot longer at the Ricoh then they do lol clueless...

Wasps will sit back they don’t need to do anything Sisu will have to go to them & hope wasps feel sorry for us...this will go down to the wire no doubt.

A lot of people's reactions show they haven't read the myth busting stuff.

The anger is that the EFL haven't removed the golden share but are now threatening to kick the club out of the league. Have a step back about how and why they can't / won't remove the goldenshare.
Good point EFL should remove the golden share if they have the power to do so with thr way the clubs being run surely they should be able to step in.

You would hope this would focus everyone's minds particularly at SISU, Wasps, CCC & EFL

The Supreme Court is expected to rule on the appeal any time now. Hopefully it gets rejected and everyone can sit down and talk like grown ups. The worst result would be to allow the appeal. Reject the appeal and draw a line under it. I am sure the various PR people will spin something positive somehow for each party

Deeply worrying. Make or break time

I could not support another team if the worst happened, that would be me done. Find something else to do away from professional sport most probably
Even if appeal is dismissed I can see them appealing that decision how thsts even possible to do is beyond me.

Think they can go to the Euro courts which is very expensive and can take ages or the civil court again very time consuming, as I have said earlier I can’t see any movement from the Wasp end until after this Supreme Court decision.

This is the thing in all this I don't get with this ongoing court case, at no point has there been any indication that the case might go their way. The case has been thrown out at every level and by every judge. What makes them think that they will suddenly be victorious?

Just drop the damn thing as the result will never go the way they want, whether people agree with the verdict or not. That has been obvious for an age now.

The only people who benefit from the continuation of these actions are the lawyers. Everyone else loses.

2 weeks to possible showdown at the ok corral ! SISU have to be the ones to blink surely.......but then they don't give a fuck about us so maybe they will let us die and walk away.......everyone will lose out though including those arseholes.

why do sisu have to blink? Their existence isn't in danger. All they've got on the line is a potential investment going tits up. I'd imagine it's a case of shit happens as far as they're concerned.
You're right those arseholes will lose out but how much will it matter to them in the grand scheme of things?

I’ve said this on another thread, we are all assuming Joy won’t sell but what if she does want to. With an apparent £7million offer sitting in the table from her point of view what better way to twist arms for a higher offer than to threaten our very existence, just a thought

Exactly. SISU is not CCFC. Otium t/a CCFC is one of their investments, ok a poorly performing one , but just one of them. They will not go tits up if CCFC goes tits up.

The aim isn’t to get awarded damages. The aim is to cost the council/Wasps so much they give in.

They haven’t had a chance of winning in court since day one, only the rabidly anti-council ever thought otherwise.

So why are the council and Wasps prepared to put the club,as we know it, out of existence, to get the case dropped?

From reading the statement the council put out, its clear they see CCFC and SISU as the same they come as one in their eyes. I think this is a very personal naive stance to take and makes it quite clear they arent willing to help the club. Its also clear that they are calling the shots even though it sounds like its from wasps, this is a bad position to be in as they back the club into the corner when the owners don't care and will get their money back if the current situation remains as they will keep pushing even if the club is gone...

Also what deal would wasps do if the legals would drop?? what if it was a 5 year deal and 5 year deal only?? would that help sisu out im guessing not! Dropping the legals is one thing no visible proposed rent agreement is another...

Thats why there is stalemate and we are left in the position of being frustrated worried and annoyed! why it means nothing to the 3 parties involved!

So far the only positives from this is the amount of other teams fans who are feeling for us and blaming the EFL.

It’s ridiculous that Sisu passed the fit and proper test twice. Moved us away from the city and promised a new stadium. Yet the only ones who are going to lose out is again is the fans.

They would need to do it by the Book OSB else SISU will use them as their next "batter them in court" process methinks

If it goes that far (to the EFL meeting in April) I can’t see a majority of clubs voting that they would want us booted out-surely not?

I wouldn’t bank on that. Rangers were completely sold down the river when a vote was cast back in 2012. 10/12 chairmen voted for them to be expelled from the SPL. I wouldn’t expect a shred of sympathy from any club if I’m honest.

Rangers had already been liquidated, the vote was whether to let the phoenix club back in to the SPL.
Different scenario though one we might find ourselves in depending on how things pan out.

Whats the other option? Keep a team in the league that has nowhere to play, the only other thing they can do is approve a move out of the city.

And I wouldn't put it past a number of owners to consider it something of a benefit to loosen the ties of clubs to places...

Joy will sell if someone offers her the right price. Problem is the price thats right for her is not what anyone will pay.
