NEWS Coventry City: ACL call for administration to be re-run

The Board of Arena Coventry Limited issued this statement on Friday in response to Football League admission of ‘administrative oversight’ with Coventry City Football Club An Arena Coventry Limited spokesman said:“The Football League’s admission that it has made serious errors in the administration of Coventry City Football Club is a crucial development in this saga. Since March, we have made the case that the football assets of the club, including player registrations, should have resided with the company with the ‘Golden Share’ – that is Coventry City Football Club Limited.“That is what all the publicly available documentation makes clear – from the 2008 board minutes that recently came to light right through to the last set of filed accounts in 2012.

It is also what the Football League’s own regulations say should be the case.“It is therefore deeply disappointing that they have waited until now – with the administration process almost over – to make this admission.

But fortunately there is still time to resolve this matter. The Joint Administrators have not yet liquidated the club so there is still time for a proper administration process to be run – one based on all the facts – that provides a fair outcome for creditors, for prospective purchasers of the club, and most of all for Sky Blues fans themselves.

Another day, another statement. What about all the stuff about suing NTFC and the FL? Why don't they just do that. "Calling" on the Football League won't achieve anything, it'll fall on deaf ears as everything else has.

If the administrator accepts this then the SISU-related companies must have the GS taken away from them, as well as control of the club. Remember the FL said they will follow to the letter what the administrator says.

I hope Paxman reads this after telling me I "was clutching at straws" and that ACL didn't have a case ? I was criticized by Paxman for emailing the Football League and requesting what ACL are doing/have done. There are far too many people on here who take delight in criticizing those who, with all good intent, ARE clutching at straws and doing something other than doing sweet sod all themselves ! No matter how trivial it may seem to others I will continue to fight tooth and nail to rid SISU -- NOPM !

VOR, problem is that FL are crapping themselves over alleged legal threats from SISU. I really do not think that anything will change. There has to be concrete proof of wrong doing by SISU/FL and Appleton, it may have to come from Parliamentary level(minister of sport et al). FL need to do the right thing and feel safe that they will not be sued.
Also sure that if admin process was re run and Appleton was involved, the result would be no different.

Process was finally admitted to be what all of us knew.... it was a sham and a fix. how could it not be with a sisu appointed administrator? not that hard to work out. Mr Clarke probably had a drink and plucked up the courage to get this out in the open. My best bet is a new CVA to be drawn up and accepted by ACL as nothing to gain from rejecting to quote Les Reid. 10 points back.

Yep I saw that FL admitted mistakes with player registrations, but have seen no evidence that Appleton or SISU have acted unlawfully. If/when accounts are filed, then this may give us an insight into when assets were shifted.
PS, I am with you and VOR all the way on this.

What proof do you need? The statement from the league which admitted the mistake said that it did not forsee that it would change the administration process or the ownership of the club and there is no way that they would have gone public about their cock up unless they were confident that it wouldn't come back to bite them. So nothing will happen. No doubt ACL will mount a legal challenge but thats becoming almost a daily occurrence.

I think the FA and FL fear more political interference.
This saga justifies calls for this to happen.
The fact that part of the mess has been a division of assets that was not understood and contrary to regs. Is at the very least a serious cock up.
I expect another announcement from Bob Ainsworth soon.

Voice of reason just wants the best for this club like I do and he like myself have emailed a million times to the FL. now why shouldn't we get our 10 points back until its confirmed both he and with hopefully others will try our best. Liquidation = 10 points now we haven't been officially liquidated and all we are saying with Fridays admission that at the very least a new CVA can be drawn up and agreed thus stopping 10 points and some agony can stop. I for one doubt ownership can change hands in fact im certain but smaller fish first and bigger fish next.

Yes, they would your right but they were under no pressure to admit their mistake which means they did it to try and re-gain some lost support. Their own statement said:

The League says its has since carried out an “audit” of all other 71 League clubs - which found there was no such division of assets between companies anywhere in the country.
The League claims the errors did not breach its rules and regulations, claiming assets can straddle two companies - but it accepts it was not “ideal” and “should not have happened”.

They wouldn't be making bold statements about this not being a breach of regulations unless they had a cast iron guarantee from their lawyers that this definitely was the case and that it couldn't come back to bite them.

I don't know the rules regarding all this but I would think there has to be a level playing field and it is up to the administrator to make sure there is, does that make him at fault and at hundreds of pounds an hour who pays for a re-run if granted. Remember Bob Ainsworth "prepare to stand aside" quote to Appleton the other week, was that an off the cuff remark or said with some knowledge. A re-run would be interesting though wouldn't it, would Appleton remain administrator, don't forget he was joint administrator so could his partner just step in or would it be a new firm.

What to me is very interesting is the fact ccfc ltd have not been liquidated yet as expected is it legalities that have held it up ? We don't know what is said behind closed doors do we. I think there's a lot of mileage in all this yet and will go on sometime and I am certain will end up in the courts.

Manchester sky blue is correct. While the FL admit errors they also clearly state it has no effect on their judgement in the case and were fully compliant with their rules.
In short ACL are clutching at straws in a great PR exercise that appears to make them less of an enemy and SISU more so. It's been their stance all along as has SISU's but it changes nothing in reality.
I suppose ACL with the likes of Elliott and Hoffman still ringing in their ears believe they can still find a way of gaining control of the football club by taking whatever distressing action they can. Sounds familiar?!
Both these sides are pretty despicable in continuing with this war of threats and insinuations. What upsets me the most is that all the time they keep spending on this continuance to find a loophole to destroy each other, would be better spent negotiating a solution to the problem of the football club not playing at the Ricoh in Coventry which is what the people of Coventry want.

Can you explain what suing NTFC has to do with this. A totally different issue and to do with Contract Law not the administration process. You sound a little disappointed that the admin. process might be flawed and there might be a re-run. How strange !!

We should all want the rules and the letter of the law to support us the fans in this sorry mess.
To date it is the fans who have suffered most.
Clutching at straws is maybe all we have and yet if that kicks down the barriers to justice then Paxman, Torcho and all of us should be grateful.

There is nothing in Contract Law, that I'm aware of, that could sue NTFC, they are not party to the contract between CCFC and ACL. There is no contract between either party.

They may have some rights as a third party but it's unlikely.

What most on here want is SISU OUT ! Face facts, unless SISU is removed the chances of returning to the Ricoh are remote. I would like to know just how you know more about this than ACL, Hoffman and Elliot when coming out with such statements ? Do tell, we are all waiting. (PS, I respect you have a right to your opinion, but 99% on here won't agree with it )
