Paul Harris just said that Chris West had told him that Sisu had been notified of change in direction re: bank loan, ie just bipartate approach to bank. In fact Sisu never informed.

PH wanted confirmation due to ethics.

He says he had to take CW as an ACL director on his word.

Wow.

He's saying there were no implied terms in the Contract that had the clause ,that should talks break down SISU were liable to £29k.contribution to Higgs costs incurred ,and once the six week period of HOT was over no right to expect exclusivity.

Which begs the question ,what relevence can there be to the counter SISU are now involved In,as i would say there Is no counter and they will be made to pay .

right - yesterday the Higgs barrister said Higgs valued their shares at 7.5 million (see Simon Gilbert twitter) - why was 5.5 million a good deal for Higgs?

Not massive for this case but massive in the wider context.

It sounds as if Higgs might be dropping the council in it?

Yes - right from the beginning yesterday.
It's been like a pattern forming - Higgs are pointing at CCC.
They certainly have done nothing to make sisu's next fixture in court difficult.

Is Chris west the one who left and was also in council?

No, he is listed on CCC website as "Director of Resources", which isn't HR but an exec post covering Finance & Legal parts of Council.

And he is listed on ACL website as a director of ACL

What we've read so far seems to demonstrate the trust between SISU and CCC is non existent and that Higgs are the piggy in the middle!

Labovich in that sky interview said that it was paid council employees working for ACL that were misleading the council and blocking progress.

No it just seems Mr West told Higgs SISU knew and I think the con census is they didn't.

It is a shame PWKH couldnt have been asked on the CVA and if he wanted it signed and who in ACL didn't.

I thought you thought this thread was irrelevant rubbish?-- a sniff of something potentially good for Sisu and you suddenly seem keen as mustard.....

Does a split between Higgs and CCC actually benefit SISU? Weren't they making out that everyone else was working together behind SISUs back to try and stich them up, if it turns out they don't get on then it would impact on that arguement.

As for SISU being kept informed what was happening then we need to know how that was supposedly done. If it was verbal it will come down to who the judge believes, if the CCC chap was supposed to have done a more formal notification then there will be some evidence to backup his claim.

I don't think it is a question of AEHC pointing fingers at CCC or its officers, more that PWKH and PH are not prepared to lie to cover up actions or inactions ...... ie they will answer truthfully.......... what was done or not done can not be altered

Possibly not, more likely not if this exclusivity period had ended - sounds like the Higgs were just being polite towards Sisu.

I suspect as SISU had broken the terms of their tenancy by withholding rent that there was no legal compunction for CCC to inform them of the change of direction, however, how much of this mess could have been avoided if they had?
