I know it's a paradoxical thing to say as I think the forum's daft anyway... but surely, *surely* they have to rearrange it now for after the verdict?!?

You would think so NW, and I agree with you I think the forum is pretty pointless too. However I accept that some see it as a step to transparency by all sides - I just feel they will be disappointed.

So, can Sisu legally say anything related to the case in public before the judge announces his decision?

Might there have been things they were planning to say, that they now can't while the judgement is outstanding?

Government expects places like the Herbert to pay its way, but won't allow it to spend money on risk.

So it's stuck between being limited in what it can do, and being ordered to try and make a return on that with one hand tied behind its back; the worst of all worlds!

It was certainly the worst of dino worlds.

ah 3 weeks...should have known.

Should give us just enough time to watch England get to the round of 16 then get knocked out, then quick court date and before you know it, it's pre-season.

What other team gives you year round entertainment?

So did anyone figure out what the "wait until the JR" brigade was expecting to see from this? From what I've read on the proceedings there has been no bombshell(s).

Have I missed something or where they just taking in by spin?

Weren't fisher and labovitch big users of the 'this is why we're having the judicial review so things can be out in open for everyone to decide'

Well it's for the judge to decide based on the evidence and the submissions and from what I've read, I can't see how sisu can win this?

Loads. I was talking in general not in the context of this site. Facebook, Radio, second rate online fans forum and not to mention ML.

From what I can see sisu's case is basically what ML has been saying in interviews (excluding the bits he was misquoted on) he's always given the impression (quite deliberately in my opinion) that it will all come out in the JR so we'll have to wait and see.

I'm still waiting. Unless someone can point out what I've missed.

Instead we have got 'key facts', supposedly written by CCFC employee Crowley.......so no bias there then

So yet another blatant lie that banks on us, the supporters, being as thick as pigshit.

It's one of the things that pisses me off about this whole saga, the level of contempt the likes of fisher and labovitch have shown the fans. Treating us like mugs, like a lesser species whilst they pick up their £50k a month or whatever it is they're being paid.

I think it could go either way on the point of law.

What I don't see is what sisu or more importantly the club will gain. The misnomer that this was going to be a big PR win for sisu in the battle for the Ricoh hasn't happened IMO. Nothing has been said that hasn't already been said, on top of that the judge is now going to dismiss some of what has been said for not being factual or relevant so the waters are being un-muddied, smoke screens are being blown away. Which is good for us I guess but from sisu's POV it seems to have weakened their case to the fans. I suppose you could take that as confirmation that we really don't figure in this where they're concerned, if you wanted to.
 
It all depends on the Judges decision. But I must point out that on the State Aid guidance and on there flow chart, the clearly states the importance of notifying the EC if there is any State Aid above 200,000 Euro's, which this was.
They have to prove it was state aid first and the EC will not call it in just because you say it is state aid. Every one is waiting for a Judge to make that ruling.

I've managed to catch up with the rest of the thread and there's a few things to add.

Procedure for judgement:
I will be made to both sides next week so they can go over the document and offer corrections (e.g. spellings, references etc. NOT to any statements or the judgment itself). It will then be given publicly in court the week of 30 June (so I assume it could be by Fri 4 July although more likely by the Thu as judges don't like to work on a Friday it seems). This is because this is the next time that the judge will be in Birmingham and officially, the judgment has to be given in the court but it will have been made by next week – but not publicly so we won't know for a while.

Transcripts:
I got people to check and they will be going out later today once released by the court. I think the intention was to try and get them released each day but this was either overlooked or not allowed. (I can check which if anyone cares enough although I'd rather not have to.)

THE JUDGENING!™
Someone who called the Higgs v Sisu result correctly was asked what they thought for this one. Basic answer: It's state aid no matter what happened with rent strikes, valuations and so forth. Make of that what you will. Personally I have no idea.

From chatting to a few of the legal folks at the end, they independently pointed out that the judge was making statements and using language like 'I put it to you...' when he should be more questioning. Apparently this can be common as judges will still use their legal experience from the time before they crossed from bar to bench, although this judge is one of only 4 in the country who had been a solicitor before rather than a QC / barrister.

Didn't have a chance for much more than casual chats with folks after and all sides disappeared off for confabs with their legal teams. Personally I'll be having a bit of a rest and some beers and footie (I vaguely remember what that is) later and then looking into how we can get some f'in negotiations going to bring us home.

Some good debate, banter and quality humour on here so hats off to all no matter what your view on the whole thing. It's kept me sane throughout some fairly tedious courtroom business :)

LOL, anyway.. there was a big argument & no one is sure who won, Lord Justice Hickinbottom will tell us sometime in the week commencing 30th June.
