Surely if it was true Sisu would need to be constructive as their part of the deal?
Otherwise Sisu could do anything they like knowing they have nothing to loose.

It will be set for a 2 day hearing
Today it was set for 2 hours but they took less than 20 minutes to decide the last judge was wrong in law and THEN went on to spell out the potential claims that could be made. They did not listen in full to SISU's lawyers - minds were made up already

Yes they pretty much dismissed the original judgement as "unsafe" - I wouldn't be quoting him amymore if I were you.

If he had have given them right to appeal in the first place would he have been dismissing his own judgement as unsafe?
Will I still be allowed to quote him if SISU lose again?

If I were the council I'd be less worried about the fact that the appeal is being allowed, there was always a chance of that, and more concerned with comments made by the judge today. They seemed fairly dismissive of the original decision.
Should the council be eventually found to be in the wrong what would the consequences be for the likes of Lucas, Reeves and West? Assume they would all lose their jobs but could they be in serious trouble?

The judges today appear to have completely dismantled the defence of 'protecting a public asset'. The appeal will be interesting.
