Judicial review day 3 - judgement day

And now Dave Johnson (KCIC) has arrived. Filling up for the final furlong it seems :-)

Judicial review day 3 - judgement day

Hey, hey...Mark Labiovich – who in some ways could take the 'credit' as the architect of today's proceedings – has just arrived with an as yet unidentified other person. I have to say, I am so tempted to pack up my things, rush to the front of the court and yell to the whole room that everyone...

Yay. We're back to Austrian dentists. I kid you not...

Judicial review day 3 - judgement day

ACL QC (Conor Quigley. Listed QC, Paul Harris (nothing to do with the Higgs trustee of the same name in attendance) is ill) going into great detail WRT previous state aid cases. Judge looks like he's having to hold his head up to stop himself from dozing off.

Weber Shandwick person wedged into the corner at the back with us. Apparently no room for Clive with the press.

Judicial review day 3 - judgement day

I had a quick chat with Clive after yesterday's proceedings (commiserated with him on not commentating at Edgbaston) and he was getting ready to do a radio piece. (It's all iPad & headphones these days.) So yes. I'll see if I can get info on when he's on but it might be recorded in for the...

I'll ask her :-) (Assuming her role as chair of stadium group makes her an interested party as well as her City fandom & professional background. Don't read too much into the seating arrangements – we're all jammed in at the back here so all together. Although is telling that the Higgs posse...

Judicial review day 3 - judgement day

Yes (paras. 21–64 in the skeleton argument – not sure if I'm allowed to broadcast so will hold off but note this for later reference) & part of their argument is that West & Reeves didn't tell councillors about the possible restructuring of the Yorkshire Bank loan. Sisu didn't get any details of...

CCC QC done, over to ACL QC

Judicial review day 3 - judgement day

Absolutely. This is why we desperately need negotiations. I'm still toying with bundling Joy Peter K-H & Chris West into a meeting room. It's intensely frustrating. Joy is 6ft in front of me, CW 8ft front right & PKH over the other side of the room.

I was actually paraphrasing her thoughts so I don't want to take credit for them! (Hence the 'Overall thought from yesterday from someone who was paying close attention' intro) on my post at #45

Judicial review day 3 - judgement day

I think this is spot on. Sisu do have loads of documents, they just haven't been able to do much with them (unlike the Higgs case). I've been trying to find out if they may ever become public. Maybe during a civil action? (*groan*)

BTW, worth following @skybluechick today. She's been tweeting furiously and seems to have been picking quite a few holes in Simon Gilbert's reporting. (For context, she's away days only but doesn't trust anyone in this dispute and just wants it over.)

Judicial review day 3 - judgement day

You might know her from Twitter as skybluechick. She was on Late Kick Off a few months ago giving a very impassioned speech on our plight. Moz Baker has been taking the piss out of her ever since :D (in a nice way – everyone loves D)

Judicial review day 3 - judgement day

Sounds like a good shout but TBH, predicting the judge's decision is, as you say, a stab in the dark. This is really involved legal stuff so get out your dartboard or wait until THE JUDGENING!! :D

Judicial review day 3 - judgement day

In rebutting Sisu's claim, the CCC QC misquoted the Sisu QC (from yesterday) which is where the argument came from. There's been a lot of discussion about the rent and if there was an agreement to reduce it, run down the escrow etc. The legal decision here (which is what counts) will be that...

Judicial review day 3 - judgement day

One thing I totally forgot yesterday: The living god that is Cyrille Regis came in for part of the day. Looking very trim and apparently still playing footie (as well as that funny stick-ball old man game). Still remembering '87 and his international appearances at Wembley. Don't think he was...

Judicial review day 3 - judgement day

Bit of a tiff with the QC's there. Sisu QC objected to being misquoted re: illegal cessation of rent payments (and he was) but the point that stopping rent payments was illegal still stands. Another potential crack in Sisu's case?

Judicial review day 3 - judgement day

Overall thought from yesterday from someone who was paying close attention: Sisu QC seemed weak but could always provide evidence and a reply when challenged by the judge. CCC QC has far stronger manner but doesn't seem to have the answers as readily when off script / challenged by judge. Key...
