Cutting through the mentalism ;) who can honestly put their hands up and say they're surprised by the result?

I'll admit to being surprised. From the outside it looked like an open and shut case that Higgs were owed the money.

Just shows why I'm neither a lawyer, nor a judge ;)

I am quite surprised, I have only read the tweets about it and it seemed the judge wasn't keen on sisu

Ditto ,seems he focused heavily on the Afters ,rather than the real/true intnetions of the Pre and during .

I taught myself not to be surprised after sisu won the JR appeal. I realised there and then that I know as much about law as grendulls accountant knows about accounting.

I was only surprised after
SISU gave evidence and the judges response to that evidence and their QC summing up.

Although the Higgs' QC never really took full advantage of SISU's evidence.

There was more on here than he used. Such as bashing people in court. Tim saying ACL were about to go bust. Tim saying public ally ACL were not worth anything really.

SISU saying the price they offered was just charity

That they were going to pull funding if they did not get a deal

That the decision to not pay rent was separate.

The Higgs QC never really dug into these points.

Maybe it will make people try to establish the facts and see things as a judge would with personal hatred aside?

Are you one of those "open minds"? Up until now I had you as a SISU spokesman...

tbh if I wanted to embark on a major media assault from the ACL side, the first thing I'd do is employ RFC as he can't help but make SISU look bad!

Must confess that after the stuff about the six-weeks exclusivity came out, I thought it was pretty much nailed on for Higgs. What was surprising was how far down the track the judge was prepared to go in digging up stuff from August and beyond. I'm also surprised at how much of an easy ride the SISU witness seemed to get compared to the AEHC ones.

You have to presume that the charity thought they had a reasonably solid case - if there's one thing that's certain about court, it's that nothing is certain about court!

In terms of the JR, there's some stuff in the document in the other thread that makes me wonder about SISU's case. I'm not convinced this result actually makes it more definite that they'll win there, but it's a sure reminder that there's no way to be certain.

I said before this I thought it had absolutely no bearing on the JR, and I'm not going to change my mind now.

Two separate cases, two different objectives.

I am not surprised. This is the nature of litigation.

Like I say, despite the warm words and soundbites, the parties rarely demonstrate any commitment to reaching an agreement.
